1. Right of Cancellation for Consumers

1.1 If a retail customer places a Website Order or Remote Order, and the AT Power Goods were not a Configured product (see section 3) the Customer has the right to cancel the Order in accordance with the Consumer Contracts Regulations 2013.

1.2 The right to cancel must be exercised within 14 days of the Goods being delivered. To do so, the Customer must get in touch with us via info@atpowerthrottles.com or call us on +44 (0)1953 857800. The customer can also write to us by post at S-CAN 3D Ltd, Unit 10b, Bunns Bank Ind Est, Attleborough, Norfolk, NR17 1QD

1.3 To exercise the right to cancel, the Customer must return their non-defected AT Power Goods in person or send them by carrier to S-CAN 3D’s premises. In some circumstances, the Customer may ask for S-CAN 3D to collect them. This must be done within 14 days of submitting the cancellation notice. The Customer is responsible for the cost of returning the Goods, and if S-CAN 3D arranges for collection, the Customer will bear the cost of that collection. The customer is responsible for packing the product adequately to avoid damage and is responsible for any damage occurred in transit.

1.4 AT Power’s returned goods will be inspected by S-CAN 3D before S-CAN 3D agrees to a refund. The goods must not have been damaged nor installed and must be in a re-sellable condition. S-CAN 3D will contact the customer if there is an issue with the product after it has been returned.

1.5 On receipt of Goods, if the goods pass inspection, S-CAN 3D will refund the Customer the price paid for the Goods (minus any delivery costs) using the same payment method used for the original purchase. S-CAN 3D reserves the right to reduce the refund to account for any loss in the Goods’ value due to miss-handling by the Customer.

2. Rights of Cancellation for Businesses

2.1 Businesses do not automatically have a right to cancel an order or return non-defective products.

2.2 If you would like to cancel or return an order, please contact us to see what is possible.

3. Definitions of ‘Standard’ & ‘Configured’ Products

Standard Products:

“Standard” products are off the shelf products which are assembled from the standard options as shown on the website. The anodising colour must be either black or silver.

Configured Products:

“Configured” products are any products which have been modified from the standard options to fit your application. It also includes all colour anodised components which are in any colours other than black or silver.

4. Cancelling Configured Products

4.1 On receipt of payment, configured orders start being manufactured. If you decide to cancel your product after ordering, costs and admin charges will likely have occurred to cover materials, manufacturing and design costs. These will be deducted from any refund offered.

4.2 Completed configured orders are non-refundable due to their custom nature and inability to be resold. However, if your needs change and you no longer require what you have ordered, please contact us – we will do our best to offer a partial refund or exchange where we can.

4.3 S-CAN 3D is dedicated to working with you to provide the best automotive solutions. However, in some cases, we may only be able to offer guidance, and there may be situations where our recommendations do not fully meet your needs. By purchasing products from us, you acknowledge responsibility for ensuring their suitability for your specific requirements. If S-CAN 3D has custom-built the AT Product to an agreed specification and it does not meet your needs, it will not be considered a ‘Defective Good,’ as it aligns with the specification you approved.

5. Returning an Item

5.1 In the event you wish to return goods, please contact us at info@atpowerthrottles.com with your issues, order reference or serial number found on the product sticker.

Please do not ship any items to us without prior confirmation from S-CAN 3D that we are able to receive the goods successfully.

5.2 The customer must use this address for returns: S-CAN 3D Ltd, Unit 10b, Bunns Bank Ind Est, Attleborough, Norfolk, NR17 1QD.

5.3 The goods are shipped at the cost of the customer. The customer is liable for the condition of the goods in transit and the condition they reach S-CAN 3D. The customer takes responsibility for dispatching goods to us within 14 days of S-CAN 3D confirming we are happy to accept a return.

5.4 For AT Power products delivered in person, we do not accept returns left outside the premises. The product must be pre-arranged for drop-off with an S-CAN 3D front desk employee during business hours. Please make sure to obtain written confirmation from us to acknowledge the receipt of your return.

6. Defective Goods

6.1 AT Power Warranty Guarantee: S-CAN 3D guarantees that, upon delivery and for a period of 12 months from the delivery date (the “warranty period”), the Goods will:

  • Be free from material defects in design, materials, and workmanship.
  • For consumer transactions, conform to the standards of satisfactory quality as outlined in the Consumer Rights Act 2015.

This warranty is valid provided that the Goods are used in a manner deemed reasonable within the context of high-performance motorsports, as determined by S-CAN 3D’s sole discretion.

6.2 Notification of Defects: If, upon collection in person from S-CAN 3D directly or delivery, any of the AT Power Goods are found to be materially defective in relation to their description or applicable specifications, the Customer must promptly notify S-CAN 3D to discuss the next steps. This does not affect the Customer’s statutory rights under consumer law.

6.3 Quality Control Inspection and Resolution: S-CAN 3D may request the return of the Goods in their original condition for a quality control inspection. Upon completion of the inspection, S-CAN 3D will inform the Customer of the findings and, if a defect is found, at its discretion, may:

  • Replace the defective Goods within 60 days, or
  • Refund the Customer for the price paid for the defective Goods.

Following this, S-CAN 3D shall have no further liability to the Customer regarding the defective Goods.

6.4 Exclusions from Liability: S-CAN 3D is not liable for defects arising from:

  • Normal wear and tear,
  • Wilful damage,
  • Negligence,
  • Exposure improper conditions,
  • Failure to follow S-CAN 3D or AT Power’s instructions (oral or written),
  • Misuse, alteration, or repair of the Goods without prior approval from S-CAN 3D,
  • Any act or omission on the part of the Customer, its employees, agents, or third parties.

6.5 Exclusion of Additional Warranties: Except where the Goods are sold under a consumer sale, all warranties, conditions, or other terms implied by statute or common law are excluded unless explicitly stated otherwise in these Terms.

6.6 Customer Responsibility for Compliance: The Customer is responsible for ensuring the use or sale of the Goods complies with all applicable statutory regulations, including any instructions provided by S-CAN 3D. This includes adherence to directions from relevant governmental or regulatory authorities. The Customer agrees to indemnify S-CAN 3D against any liability, loss, or damage resulting from non-compliance with these conditions.

7. Customer’s Default

7.1 If the Customer fails to make any payment on the due date, then, without prejudice to any other right or remedy available to S-CAN 3D, S-CAN 3D shall be entitled to: –

  • Cancel the order or suspend any further deliveries of Goods and Services to the Customer;
  • Appropriate any payment made by the Customer to such of the AT Power Goods and Services (or the goods supplied under any other contract between the Customer and S-CAN 3D) as S-CAN 3D may think fit (notwithstanding any purported appropriation by the Customer.)

This condition applies if:

  • The Customer fails to perform or observe any of its obligations hereunder or is otherwise in breach of the Contract or
  • The Customer becomes subject to an administration order or makes any voluntary arrangement with its creditors (within the meaning of The Insolvency Act 1986) or (being an individual or firm) becomes bankrupt or (being a company) goes into liquidation; or
  • An encumbrancer takes possession, or a receiver is appointed, of any of the property or assets of the Customer; or
  • The Customer ceases, or threatens to cease, to carry on business; or
  • S-CAN 3D reasonably apprehends that any of the events mentioned above is about to occur in relation to the Customer and notifies the Customer accordingly.

7.2 If section 7.1 applies then, without prejudice to any other right or remedy available to S-CAN 3D, S-CAN 3D shall be entitled to cancel the Contract or suspend any further deliveries under the Contract without any liability to the Customer, and if the Goods have been delivered but not paid for the price shall become immediately due and payable notwithstanding any previous agreement or arrangement to the contrary.

8. Refurbishment Services and Spare Parts

8.1 You might like to refurbish your AT Power products after prolonged use. All refurbishments are completed at our headquarters in Attleborough, UK. The service helps to extend the life of you AT Power products. You may also like to find a specific spare or individual part. 9. Refurbishment Cancellation Policy

9.1 Cancelling an Initial Inspection: If you have sent your throttles or oil pump to us for refurbishment but the initial inspection or test has not yet begun, you may cancel the inspection. In such cases:

  • We will refund the inspection fee minus an administration fee of 20% and the cost for the return delivery.

If the initial inspection or test has already started, cancellation will no longer be possible, and the full inspection fee will apply.

9.2 Inspection and Cost Estimate. Following the completion of the initial inspection:

  • You will receive a detailed report outlining the recommended work with a cost sheet detailing labour and parts as well as any available optional upgrades.
  • You can decide whether to proceed with the recommended work. If you would like to proceed, work will commence on receipt of payment.
  • By choosing to proceed, the customer acknowledges that, due to the uncertain condition of the throttle or oil pump, AT Power cannot provide a service warranty for refurbished parts.

9.3 Proceeding with Refurbishment: If you agree to proceed with the recommendations:

  • Refurbishment will begin upon receipt of payment for the full cost of the agreed refurbishment and parts.
  • Once Refurbishment has begun, cancelling is not possible.

9.4 Shipping Costs: Customers are responsible for all shipping costs associated with sending and receiving products for servicing and refurbishment.

10. Product Refunds

10.1 Once S-CAN 3D has agreed in writing to issue a refund, the refund will be processed through the Customer’s original payment method. S-CAN 3D will notify the Customer if any applicable fees will be deducted from the refund. S-CAN 3D will not make any refunds without receiving and inspecting goods.

10.2 The refund will be based on the original amount received rather than the invoice amount (if different).

10.3 Card payments will be securely processed via trusted third-party platforms such as Stripe or PayPal.

10.4 In the event of a payment error, S-CAN 3D reserves the right to correct the refund amount within one week of issuing the refund.

10.5 S-CAN 3D will arrange for any property of the customer to be returned to the customer. The customer is responsible for shipment costs.

10.6 If we are unable to provide an AT Power product, for example, if the product is out of stock, no longer available, or there is a pricing error on our website, we will notify you via email and will not proceed with your order. If you have already made payment for the product, we will issue a full refund as soon as possible.

10.7 Once a refund is processed, S-CAN 3D shall have no further liability to the Customer for that AT Power product or service.
